1. Agreement to Terms

By accessing or using pepta's website, services, or applications (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Services. pepta reserves the right to modify these Terms at any time. Continued use after changes constitutes acceptance.

2. Description of Services

pepta is a technology platform that connects patients with licensed, board-certified physicians for telehealth consultations related to peptide therapy. pepta is not a healthcare provider, does not practice medicine, and does not provide medical advice, diagnosis, or treatment. All clinical decisions are made independently by licensed physicians through our partner provider network.

Use of the platform does not create a doctor-patient relationship with pepta. A doctor-patient relationship is established only between you and your prescribing physician upon completion of a clinical consultation.

3. Eligibility

You must be at least 18 years old and a resident of the United States to use the Services. By using the Services, you represent that the information you provide is accurate, complete, and current, and that you have the legal capacity to enter into these Terms.

4. Telehealth Consent

By submitting a health intake form, you consent to a telehealth consultation with a licensed physician. You understand that telehealth involves the delivery of healthcare services using electronic communications and that it has limitations, including the inability to perform physical examinations. You have the right to withdraw consent at any time.

5. Compounded Medications

Medications prescribed through pepta are compounded by licensed US 503A compounding pharmacies. Compounded medications are not FDA-approved. The FDA does not verify the safety, effectiveness, or quality of compounded drug products. All compounded medications require a valid prescription from a licensed physician. A Certificate of Analysis (COA) is included with each shipment.

6. Not Emergency Services

pepta is not a replacement for emergency medical services. If you are experiencing a medical emergency, call 911 or go to your nearest emergency room immediately. Do not use pepta for urgent or emergency medical needs.

7. Subscriptions and Billing

pepta subscriptions are billed monthly on a recurring basis. By subscribing, you authorize pepta to charge your payment method on file each billing cycle. Prices are listed on the website and may change with 30 days' notice. All prices are in US dollars.

8. Cancellation

You may cancel your subscription at any time before your next billing cycle through your dashboard or by contacting support@pepta.com. Cancellation takes effect at the end of your current billing period. No refunds are issued for partial months. See our Refund Policy for additional details.

9. HSA/FSA Eligibility

Physician-prescribed peptide therapy may be eligible for HSA/FSA reimbursement. Eligibility depends on your specific plan. pepta provides invoices and documentation to support claims but does not guarantee HSA/FSA approval.

10. Intellectual Property

All content, trademarks, and intellectual property on the Services are owned by pepta or its licensors. You may not reproduce, distribute, or create derivative works without written permission.

11. Limitation of Liability

To the maximum extent permitted by law, pepta's total liability to you for any claims arising from or related to the Services shall not exceed the amount you paid to pepta in the 12 months preceding the claim. pepta is not liable for any indirect, incidental, special, consequential, or punitive damages.

12. Dispute Resolution

Any disputes arising from these Terms or the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration. You may opt out of this arbitration clause within 30 days of first using the Services by emailing legal@pepta.com.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
